Declaration of Separation

and the

Formation of Western New York

Join me in the belief that the major issues we face today are best resolved by a separation from the State of New York. Just as there is a North Carolina, a South Carolina, a Virginia, a West Virginia, a North Dakota, a South Dakota now is the time for a Western New York. Let this Western New York be a renewed allegiance to the original intent of the founding fathers.

It has become apparent that the citizens of Western New York have little or nothing in common with the residents of the eastern part of the state. Therefore, in the course of human events it has become necessary for the people of Western New York to dissolve the political bands which have connected them with the State of New York.

As so stated in the Declaration of Independence:

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable rights that among these are Life, Liberty and the pursuit of happiness. That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, That whenever any form of government becomes destructive of these ends, it is the right of the people to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their safety and happiness. Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shown, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed. But when a long train of abuses and usurpations, pursuing invariably the same object evinces a design to reduce them under absolute despotism, it is their right, it is their duty, to throw off such Government, and to provide new guards for their future security.  

Such has been the patient sufferance of Western New York; and such is now the necessity which constrains them to alter their current system of Government. The history of the present State of New York is a history of repeated injuries and usurpations, all having in direct object the establishment of an absolute tyranny over the people of Western New York. To prove this, let facts be submitted to a candid world.  

  1. That the 17th Amendment to the Constitution has guaranteed that no member of the United States Senate will ever be or has been elected from the Western part of New York State leaving our residents without voice.  
  2. That the United States Senators Chuck Schumer and Kirsten Gillibrand have hastily adopted plans supported by ambitious, hasty, disorderly men and women without the thought or consequence to future generations.
  3. That we in the Western part of the State have little in common with those who dwell in the cities of New York, Long Island or Westchester.
  4. That the United States Senators Chuck Schumer and Kirsten Gillibrand have condoned and voted for the Federal Government bailout of private industries at the expense of the people without just cause.
  5. That they now condone the Government ownership of production, which emboldens a tyrannical government, and embraces the ideology of socialism, and communism.
  6. That they have been too liberal in their grants of salaries to individuals at the expense of the people without just cause.
  7. That they have supported and voted for a health care reform bill without thought or consequence to the people Western New York and  that the sole intent of said health care is to wage further economic war upon the people of Western New York.
  8. That they with the support of the health care reform bill seek to enslave our children and future generations shackling them with laws that turn every citizen into a criminal. That they seek nothing more than a means of setting precedent for the weak to control the strong. That they have done this to secure votes at the expense of freedom.
  9. That they have created oppressive regulations that have diminished the State of New York’s ability to compete with other States.
  10. That they have imposed an oppressive tax scheme upon the citizens of Western New York.
  11. That they with this oppressive tax scheme have infringed upon the private property rights of the individual, thus eliminating private property rights in its entirety. This oppressive tax scheme establishes a leasehold interest for the people of New York with the State of New York, thus creating a society of serfdom and a tyrannical government. For surely, if we the people are unable to pay our private property taxes said property shall be forcibly taken from its very citizens.
  12. That they have erected a multitude of State Offices and sent hither swarms of State and Federal Officers to harass the good people of Western New York all in an effort to prosecute for profit while seizing the people’s private property and revenue.
  13. That the Constitution grants us the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures. That they condone searches, seizures, road blocks, and wiretaps which are set up at unusual times and in uncomfortable areas for the sole purpose of searching and seizing the private property of the individual.  These actions are nothing more than an oppressive tax scheme to infringe upon the private property rights of the individual and to further raise revenue as fees and fines are instituted.
  14. That they have created a two-class system of justice, one for themselves and one for the people of Western New York. Mock trials and mock hearings are held to merely censure a politician while the people of Western New York are forcibly detained for the same actions.
  15. That they have promised to create jobs in Western New York for years, yet all we have experienced for decades are jobs lost to other States due to mandates and regulations. These mandates and regulations have created oppressive regulations where the people of New York are now forced to flee the State of New York for sustenance and salvation.
  16. That they have killed the job creation abilities of the individual all while placing financial mandates upon the people of Western of New York that are no longer sustainable.
  17. That they have regulated our resources and our waterways, thus taking control of said resources and waterways, all the while destroying our towns and destroying the future lives of Western New York.
  18. That they have endorsed the regulation of how we heat our homes by proposing a ban on wood stoves that provide many in Western New York the ability to survive the harsh winters. These regulations are nothing more than an oppressive tax scheme to infringe upon the private property rights of the individual and to further raise revenue as fees are instituted. Yet, when we can no longer afford said fees the scheme then becomes to make those in Western New York criminals in the eyes of the candid world.
  19. That they have voted against making English the official language of the land.
  20. That they have voted against securing our borders in an effort to secure votes and thus creating a special constituent class of voters.
  21. That they have imposed regulations upon the people of Western New York without our consent.
  22. That they have placed their offices and conducted their business at unusual times and uncomfortable and distant places, for the sole purpose of fatiguing the people of Western New York into compliance with their measures.
  23. That they have acted with such fiscal irresponsibility that they have placed local municipalities into a position of raising revenue by any and all means, by turning peace officers into revenue officers, by turning school boards into revenue generators, by raising fees and regulating every aspect of the individual’s life.
  24. That they have camouflaged its absolute power. We have become enslaved by a state that has become so desperate for money that it shall seek any regulation, any fee to justify its needs for money, money which it uses to promise favors in order to secure votes.
  25. That they have made local and county officials dependent on their will alone, for the tenure of their offices, and the amount and payment of their salaries.
  26. That they are engaged in limiting our freedom of speech by allowing the Federal Communications Commission to enact control over the airwaves and internet by usurping the legislative process. They have done so in an effort to control the message.
  27. That the Constitution grants us the right to bear arms without infringement. Yet they have placed fees, regulations and burdensome restraints on said right.
  28. That they have enacted so many laws that they have corrupted the judicial branch of government. A branch of government that adheres to the mantra that ignorance of the law is no excuse. Yet, with so many laws it is impossible for anyone person to know all the laws, creating a system where ignorance of the law is an excuse.
  29. That they have created an oppressive State where freedom has been replaced by regulation.

The sole purpose of government, as stated in the Declaration of Independence, is to secure our unalienable rights given us by our Creator. When a State Government becomes so oppressive, so regulatory and grows beyond its scope, it is usurpation, and liberty is compromised.

The State has been deaf to the voices of Western New York, voices that have no true representation. We who reside in the Western region of the state are vastly out numbered by those of the downstate region and we must, therefore, acquiesce in the necessity, which denounces our separation.

We, therefore, the good people of Western New York whose signatures are affixed, appeal to the Supreme Judge of the World for the rectitude of our intentions.  In the name and authority of that Supreme Judge we solemnly declare and publish that the people of Western New York are, and by right ought to be, free, and should be able to reside in an independent state.

Join me, Joseph Roosa, in the belief that the major issues we face today are best resolved by a separation from the State of New York and that the consequence of every new regulation is a freedom lost. Let us pledge a renewed allegiance to freedom, not regulation. The time has come for Western New York to separate from the State of New York.

So you are getting tired of having your businesses, your jobs, and your children forced to relocate to Texas so they have a fighting chance to make something for themselves? I applaud your patriotism! If you do not believe Mr. Revere above, go to a Bills’ game, and the 3rd world bevior will be very apparent!

    As we are seeing the people in Egypt and other mid eastern countries not happy with their governments take action to better themselves, and the white house supports them.
    Why can’t we as Americans have the right to separate western New York from the rest of the state. It seems our elected officials only care about special interest groups and not the people of western New York. You have my support.

    I came to Western New York 40 years ago for the diverse environment; in three hours we can go anywhere for anything; Toronto for a show, Pittsburgh for shopping. I own acreage here and at some point I will no longer be able to afford my property taxes. I grew up on Long Island and knew I could not live my life there in the liberal bastion that downstate represents. Here, with like-minded people I have made my home and feel the threat daily from our representatives. Throughout many economic downturns, I have always said that Western New York was always depressed economically. I have advocated breaking away from downstate as we of Western New York can no longer afford to take care of downstate’s needs. We are fiscal conservatives and are more than capable of taking care of ourselves; we know we cannot take care of everyone and we know we should not have to. Let the eastern half of the State self-destruct independently without our money.

Your list of 29 facts echoes the things I have been saying for several years now. Especially items #1,3,8,9,12,15,16,21,23,27,and most of all29!     I am wholeheartedly behind this movement, it’s about time. Let the eastern part of the state take care of their own problems, we have enough of our own. Every western new yorker who is fed up with our taxes, corrupt and incompetent officials, unemployment rates, etc…,etc… needs to sign this!! We as western new yorkers have gone to long without a voice, rise up!! It’s time for a change. By the way, where exactly do we sign??

    Mr. Roosa has not been able to get a signature page up and running as of yet, that is why there is no place to sign. We need to show that we are serious and stand behind him, otherwise why would he put forth the effort of putting up a signature page?? This site should be flooded with comments and support for this cause, yet it is not. Why?? If we are not willing to stand up for ourselves nothing will ever change. Please tell your friends and family, even total strangers, about this cause. If there are enough of us, if we make enough noise, Albany will have no choice but listen.

    Separating the Eastern half of New York State from Western New York State is a fantastic idea! Break around Oneonta? Let Albany continue to serve the Eastern half of the State’s interests and make Buffalo or Rochester the Capital of Western New York State. I’m a supporter!

    I like it, sign me up. We don’t own our homes or property, we just rent it from the state. If you don’t pay your property taxes they take your property. Of all the taxes there is that is the most unfair. You have bought and paid for it, why do they have any right to it or to tax you on it. There should be no taxes on any necessity such as your home, food, clothing, medicine, utilities, or a constitutional right such as the purchase of a firearm. Where do we chop it off at? I-81 is kind of a nice line right up through the middle of the state. We need to think about where it will leave as many liberal areas as possible on the East side of the new state line so they are with NYC. We don’t need them poluting Western New York State government. Can I offer that as an amendment to our new state constitution, “no liberals allowed”, LOL. We’ve witnessed all the mistakes that the current 50 states have made so we ought to be able to write an extreeeemly solid state constitution by using the best points of theirs. Man I love it, we could be the envy of the other 50. It could just reverse the huge outflow of people to other states. Like I said, sign me up, or more like where do I sign.

    I would have to say that is the best idea i have heard since my parents told me I could’t fly. There are to many regulations and laws that revolve around those on the east coast and we have to suffer for it. The New York govenment allows for to many people to sit around there house and milk the system while othere have to work two jobs to support their family, so what happens? Raise the taxes again to account for more useless people Why not, its New York right. Well it’s wrong and we working people can work together to get something done right for a change and send useless people back to the east coast along with our government. ANYTHING IS POSSIBLE!!!

    Where do I sign? For years I have struggled in WNY as it slowly withers and dies while the eastern part of the state along with our “elected officials” idly grows fat. The most appropriate description that I can come up with is that it is a parasitic relationship. I am tired of the copious amount of ridiculous regulations that are forced upon me. Our law enforcement officers are now pulling double duty; not only do they serve and protect but their hands are forced by pressure from/and laws written in Albany to harass and collect. I was rather annoyed to learn that it is now illegal to let my car warm up in the morning. This helps avoid potential expensive mechanical issues so that hopefully I can get a few more miles out of it , but as I drive to work I realize that it probably doesn’t much matter as my car is chewed to pieces by our wonderfully maintained roads. There are many many examples, this is just the most recent. I have made plans to join the mass exodus from WNY (comprised mostly of young educated citizens) and relocate for a chance at a better life somewhere else. It is sad really because I love this place and all it has to offer but as taxes go up, school budgets go down, good paying jobs continue to disappear, more and more of my personal freedoms are taken away, and in general things continue to deteriorate, it is my best option. I firmly believe that if WNY were to be relieved of the burden of NYC along with a small portion of eastern NYS, the “new” New York would thrive. The people here are strong and determined, as they have to be under the circumstances. Although I fear it is too late for me as I plan to move somewhere that my future family will have more opportunity, I fully support your endeavor and hope you succeed.

      The mass exodus you speak of is not only composed of young college graduates; we are facing leaving the area due to unemployment. We bought our first home in 2007; every year since then, we have been laid off. We’re not sure if we’ll be in Western New York to see the secession. It will be a great relief for the region to be released from the shackles of New York City and the Albany circus.

    I agree AND I live in NYC. (Brooklyn Heights) I was born and raised in Syracuse and still own land there but I have lived in NYC since 1994. I love NYC but agree that there is little to nothing in common with upstate. I just don’t know where you should draw the line. Albany?? I suggest that that same chasm exists between northern and southern California. Where do I sign?? By the way, my husband is a Haiti earthquake survivor who was missing for several days. I called Gillibrand’s office and got a recording that they don’t take calls before 10AM!!!!!!! They got back to me Jan 22 ,2010, TEN days after the fact. 318,000 people died and they wanted to know “where they dropped the ball” and I have a witness to this return call. She is a complete idiot. She was on every news station blah blah blah about Haiti but was too busy to get back to, probably, her only NY constituent who had a missing loved one there.

    It would be easier to starve out the liberal coasts all around than fight for separation, they just need an education that shows them that money is not make by moving pieces of paper or punching a keyboard, money comes from the ground and only then with some sweat and effort. The simply need to be hungry for good long while.

    As a business owner for 20 years in the state of NY and having made several trips to Albany to speak with our representatives , only to become more frustrated , it would be great to see this happen . Although I have sold my business , knowing that things weren’t going to get any better in NY , I still have a home and some rental properties here . We are considering to sell all and relocate , but this seperation might just keep us here . Hope this happens soon before its to late for many .
